MARY TUITION CLASSES

Please read these Terms and Conditions carefully before enrolling your child. By securing our services, you agree and accept to abide by the rules detailed and herein mentioned below.  If you do not agree to these terms, please do not use our website or services. 

Terms of Service

By choosing to visit and/or avail any Services provided by Mary Tuition Classes, you agree to these Terms (as may be amended from time to time). Please read the following information carefully. If you are a parent or guardian and you provide your consent to your child’s use of the Platform, you agree to be bound by these Terms in respect to their use of the Platform. By your continued access or use of the Platform, you signify your agreement to be legally bound by the Terms set forth herein. If you do not agree to the Terms of this agreement, promptly exit this page and stop accessing the Services.

Intellectual Property Rights

Mary Tuition Classes retains all rights (including copyrights, trademarks, patents, designs, logos, trade-dress, trade-secrets, know-how as well as any other intellectual property right) in relation to all information provided on or via this Platform (including but not limited to the curriculum taught, all texts, graphics, photos, illustrations, apps and logos). You shall not copy, download, publish, distribute or reproduce any of the information contained on this Platform or social media in any form without the prior written consent From Mary Tuition Classes.

License to Use

Mary Tuition Classes hereby grants You and the Child, the limited right to access, view and use the Platform only for the purposes of accessing, viewing, posting or submitting User material, using the embedded link function, placing store orders or for accessing information, applications and services. Mary Tuition Classes reserves the right to suspend or deny, in its sole discretion, your access to all or any portion of the Platform. This license is limited to personal and non-commercial uses by You and your Child. Any rights not expressly granted to You herein are reserved to Mary Tuition Classes.

1. Scope of Services

This policy applies to all services provided by Mary Tuition Classes, including Online Tuitions, Private Home Tuitions, 1 on 1 and Group Tuitions. We cater to students from Nursery to 10th Standard across ICSE, CBSE, and Maharashtra State Board.

. Registration, Admissions, Enrollment , Administrative Fees.

• Students/Parents / Guardians: The student registration fee is ₹5,000. This amount is strictly non-refundable and subject to change without prior notice.

• Tutors: Any registration or processing fees paid by tutors to join our network are entirely non-refundable.

• Non-Transferable: Any access to our services, products, tutor registrations, or student subscriptions is strictly non-transferable to any other individual.

• Students / Parents / Guardians must complete the Registration / Admissions / Enrollment process to enroll in our courses.

• Parents / Guardians / Students accept to pay All Tuition Fees and charges in advance before Start classes.

• The Mary Tuition Classes reserves the right to accept or reject any Registration / Admissions / Enrollment.

2. Tuition Fees, Billing, and Late Penalties

• Advance Payment: All Tuition fees must be paid fully in advance.

• All tuition fees must be paid in full advance Before Joining the Tuition Classes. All Following Tuition Fees , Charges must be paid before the start of the respective billing cycle and All Tuition Fees and Charges must be paid on or before the 1st of every calendar month. 

• Non-Refundable: Paid fees are non-refundable and non-transferable under any circumstances.

• Late Fee: Payment delayed beyond the due date will attract a penalty fee of ₹500 per week.

• Modes of Payment: Digital transfers via UPI, Net Banking, NEFT , IMPS , cheques and Cash only.

3. Attendance, Cancellations, and Punctuality

• Fixed Session Window: Sessions will begin strictly at the scheduled time. If a student joins or arrives late, the session will still conclude at the designated hour without any time extensions.

• 24-Hour Notice Policy: Parents must provide at least 24 hours’ prior notice to cancel or reschedule a scheduled class.

• Lapse of Class: Failure to notify Mary Tuition Classes at least 24 hours in advance will result in the session being marked "Present" and billed fully, with no makeup session or refund provided.

• On-Time Start: Sessions will begin strictly at the scheduled time.

• No Extra Time: If a student joins late, the session will still end at the designated hour.

• Prior Intimation: Parents must give at least 24 hours' notice to cancel or reschedule a class.

• Lapse of Session: Failure to notify 24 hours in advance results in the class being marked "Present" with no makeup session.

• Mary Tuition Classes is not responsible for any missed classes by the student..

4. Technical Requirements (For Online Tuitions)

• Hardware: Parents must ensure the student has a working laptop/tablet with a functional webcam and microphone.

• Connectivity: A stable, high-speed internet connection is mandatory.

• Environment: A quiet, distraction-free room must be provided for the student during class hours.

• Technical Issues: Time lost due to internet connectivity failures on the client's / Students end will not be compensated & without Refund.

5. Home Environment & Safety (For Private Home Tuitions)

• Guardian Presence: A parent or an adult guardian must always be present in the house during the entire tuition duration.

• Study Space: A well-lit, quiet, and well-ventilated study table environment must be provided.

• Code of Conduct: : Tutors must be treated with the utmost professionalism and respect. Any form of verbal, physical, or emotional abuse will result in the immediate and permanent termination of services without a refund

• Mary Tuition Classes reserves the right to suspend or expel students in case of disciplinary issues, Without any Refund.

6. Academic Performance & Responsibility

• Effort Sharing: Academic improvement depends heavily on the student's cooperation, self-study, and parental supervision.

• No Guarantees: Mary Tuition Classes provides high-quality guidance but does not guarantee specific marks or pass percentages.

• Homework: Students must diligently complete all homework and assignments allocated by the tutor.

7. Cancellation & Refund Policy

• No Refund on Registration: All and any kinds of Registration Fees process involves profiling, matching, and onboarding of tutors/students, any kind of Registeration Fees charged is purely Non- Refundable, the ₹5,000 registration Amount is Non- Refundable.

• Tuition Fees: Only Term-based tuition fees may be subject to prorated refunds only under exceptional circumstances, solely at the discretion of Mary Tuition Classes management. (ie) Fees Paid for full 12 months in advance.

8. General Terms & Conditions

• By paying the registration fee, both parents/Students and tutors formally acknowledge and provide their explicit acceptance to the above Refund policy, as well as our overall Terms and Conditions and Privacy Policy.

• Agreement: If you do not agree with the Terms and Conditions, Privacy Policy, or Refund Policy, you are requested to immediately cease using our website and refrain from availing of our services and products.

9. Purchase of Study Materials & Copyright

• Usage Restrictions: Any physical or digital study materials, practice papers, or worksheets purchased from Mary Tuition Classes are meant solely for the enrolled student's private practice.

• Copyright Infringement: Redistribution, resale, copying, or digital sharing of these proprietary materials on public platforms or with third parties is strictly prohibited and constitutes a breach of copyright laws.

Termination

Without limiting any other rights that Mary Tuition Classes may have, Mary Tuition Classes may remove, restrict, cancel or suspend access to and/or use of the Service and any part of it, if Mary Tuition Classes considers (in the sole discretion of Mary Tuition Classes) that You have breached any of these Terms.

You may also terminate your agreement with Mary Tuition Classes by ceasing to access the Service, deleting all copies of the Service or part thereof within your control. Termination shall not affect any rights or remedies, which have accrued up to the time of termination.

Indemnity

You agree to indemnify and hold us harmless, our contractors, and our licensors, and respective directors, officers, employees and agents from and against any all claims and expenses, including attorneys’ fees, arising out of their use of the Services and/or the Platform, including but not limited to the violation of these Terms by the Users.

Termination & Indemnity

• Breach of Terms: Mary Tuition Classes reserves the complete right to restrict, suspend, or terminate service access for any student, parent, or tutor found to be in violation of these Terms and Conditions.

• Indemnification: You agree to indemnify, defend, and hold harmless Mary Tuition Classes, its directors, instructors, and contractors from and against any claims, losses, or legal liabilities arising from your violation of these terms or misuse of our educational services.

Severability

If any court or competent authority finds that any provision of these Terms (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these Terms shall not be affected.

10. Governing Law & Jurisdiction:

Governing Law: These Terms and Conditions shall be governed by, interpreted, and construed in accordance with the substantive laws of India.

Dispute Resolution: Any dispute, controversy, or claim arising out of this agreement shall be settled through binding arbitration under the Arbitration and Conciliation Act, 1996 (including any statutory modifications thereof).

Jurisdiction: The arbitration proceedings shall take place in English, and the competent courts located in Mumbai, India shall hold exclusive legal jurisdiction over any matters arising from this agreement.
