TERMS AND CONDITIONS FOR PARENTS AND GUARDIANS

MARY TUITION CLASSES

Please read these Terms and Conditions carefully before enrolling your child. By accessing our platform, paying the registration fee, or utilizing our services, you (the Parent/Guardian) agree to be legally bound by these terms. If you do not agree, please cease using our services immediately.

1. Legal Capacity and Scope of Services

• Contracting Party: Since students are minors, this contract is executed strictly between Mary Tuition Classes and the Parent or Legal Guardian ("Parent"), who assumes full financial and behavioral responsibility.

• Scope: These terms govern all educational services, including Online, Private Home, 1-on-1, and Group Tuitions.

• Academic Range: We cater to students from Nursery to 12th Standard ( Commerce stream Only) across ICSE, CBSE, and Maharashtra State Board.

2. Registration, Admissions, and Enrollment

• Registration Fee: A one-time, non-refundable registration and administrative fee of ₹ is applicable per student, which will be mentioned to the parents at the time of admissions.

• Admission Discretion: Mary Tuition Classes reserves the absolute right to accept, reject, or terminate any registration or enrollment at its sole discretion.

• Non-Transferability: Subscriptions, account access, and enrollment privileges are strictly non-transferable and cannot be assigned to any other student.

3. Tuition Fees, Billing, and Financial Penalties

• Advance Payment: All tuition fees must be paid completely in advance on or before the 1st day of every calendar month or prior to the launch of a new billing cycle.

• Late Payment Penalty: Payments delayed beyond the due date will automatically attract a late fee penalty of ₹ which will be mentioned to the parents for defaultering in their payments .

• Payment Modes: Payments are accepted via UPI, Net Banking, NEFT, IMPS, Cheques, and Cash.

• Fee Revisions: Mary Tuition Classes reserves the right to modify its fee structure without any prior written notice to the parents.

4. Attendance, Rescheduling, and Punctuality

• Fixed Session Window: Sessions start strictly at the scheduled hour. If a student arrives or logs in late, the session will still end at the designated time. No time extensions will be granted.

• 24-Hour Notice Policy: Parents must provide written notice at least 24 hours in advance to cancel or reschedule a session.

• Lapse of Session: Failure to provide a 24-hour notice will result in the session being marked "Present". The session will be fully billed, and no makeup class or refund will be provided.

5. Technical Requirements (For Online Tuitions)

• Hardware: The Parent must provide a functional Laptop, Desktop, Smartphone or tablet equipped with a working webcam, clear microphone, and operational speakers.

• Connectivity: A stable, high-speed internet connection is mandatory.

• Environment: The student must study from a quiet, well-lit, distraction-free environment.

• Technical Failures: Class hours lost due to connectivity or hardware issues on the student's end will not be compensated, rescheduled, or refunded.

6. Home Environment and Safety (For Private Home Tuitions)

• Mandatory Guardian Presence: A parent or an adult guardian must remain present inside the house for the entire duration of the home tuition session.

• Physical Setup: The Parent must provide a well-lit, quiet, properly ventilated, and professional study desk setup.

• Zero-Tolerance Abuse Policy: Tutors must be treated with professional respect. Any verbal, physical, or emotional abuse by the student or parent will result in immediate service termination without a refund, alongside potential legal actions.

7. Intellectual Property and Usage Restrictions

• Proprietary Rights: Mary Tuition Classes retains exclusive intellectual property rights over all logos, graphics, websites, curricula, worksheets, practice papers, and study materials.

• Copyright Prohibitions: Any physical or digital material provided is for the enrolled student's private use only. Copying, selling, sharing, or distributing these materials on social media, public platforms, or with third parties is strictly prohibited and legally actionable.

8. Academic Performance and Disclaimers

• Shared Responsibility: Academic progress depends on student diligence, consistent homework completion, self-study, and parental supervision.

• No Guarantees: While Mary Tuition Classes delivers high-quality pedagogy, it does not guarantee specific marks, academic grades, or pass percentages.

9. Cancellation, Termination, and Refunds

• No-Refund Rule: All registration fees, Tuition fees and charges, and short-term and crash course tuition fees are strictly non-refundable and non-transferable under any circumstances.

• Term-Based Exception: For long-term fees paid 12 months fully in advance, prorated refunds may be evaluated solely under exceptional circumstances at the absolute discretion of management.

• Disciplinary Expulsion: Mary Tuition Classes reserves the right to suspend or permanently expel any student for misconduct or behavioral issues without issuing a refund.

10. Indemnity and Liability Limitation

• Indemnification: You agree to protect, defend, and hold harmless Mary Tuition Classes, its directors, instructors, and contractors against any losses, legal liabilities, or costs arising out of your breach of these terms.

• Liability Cap: To the maximum extent permitted by Indian law, Mary Tuition Classes' total liability for any operational dispute shall not exceed the total tuition fee paid by the parent in the single month preceding the dispute.

11. Severability

• If any provision of these Terms is deemed invalid, illegal, or unenforceable by an Indian court, that specific provision shall be severed. The validity, legality, and enforceability of the remaining provisions will remain completely unaffected.

12. Governing Law, Arbitration, and Jurisdiction

• Governing Law: This agreement shall be governed and interpreted according to the substantive laws of the Republic of India.

• Dispute Resolution: Any conflicts or claims arising from this agreement will be settled through binding arbitration conducted in the English language under the Arbitration and Conciliation Act, 1996.

• Jurisdiction: The parties agree that the competent courts located in Mumbai, India shall hold exclusive territorial jurisdiction over all matters connected to this agreement.
